1. GENERAL
1.1. When you arrange a ride for a taxi, minicab, or minibus using this website, your agreement to the terms presented here is confirmed by checking the box labeled “I agree to Taxipoint Terms and Conditions.” If you’re making the booking for someone else, by checking the box, you’re asserting that you have their permission to accept these terms on their behalf.
1.2. Any variation from these Terms is only considered valid if Taxipoint explicitly verifies them in writing.
1.3. If any aspect of these Terms is deemed unlawful or inconsistent with public order by a qualified judge, that specific aspect will become null and void. In contrast, the remaining Terms continue to be valid. Instead of the voided element, a clause that most closely matches the parties’ original intent will be applied.
1.4. Taxipoint will be a liaison between you and the provider, helping establish a contract. However, Taxipoint is not a party to the agreement concerning the provision of transport service by the provider to you. This contract is exclusively between you and the provider. The Services are only provided under the provider’s name and terms, based on the provider’s rates and conditions.
2. USE OF TAXIPOINT WEBSITE
2.1. When you make a reservation through this website, it’s essential that you provide accurate information. You hold full responsibility for any inaccuracies.
2.2. By using Taxipoint, you confirm that you are at least eighteen years old and legally capable of making the reservation.
2.3. Taxipoint cannot guarantee the fulfillment of your specific needs and retains the right to reject any reservations you intend to make or to cancel any existing reservations. In such an event, any payment you’ve made would be refunded in full, closing any potential claims you may have.
2.4. Taxipoint will record your details and data related to your website usage. However, per the Taxipoint Privacy Policy, your data won’t be disclosed to third parties other than the service provider or used for any unrelated purposes.
2.5. When you visit the Taxipoint website, a small file or “cookie” may be sent to your computer. This helps Taxipoint to track your activities on the site and identify areas of interest, thus enhancing your future website visits. The cookie does not enable Taxipoint to identify you personally and will be used exclusively on this website. You can set your browser to reject cookies, although this may limit the use of certain website features. Taxipoint may be required to disclose your data by law or upon the request of law enforcement agencies or governmental authorities.
3. BOOKINGS
3.1. As you input your trip details, Taxipoint strives to provide you with price quotes from service providers capable of meeting your needs through the website. These quotes represent unique, current offers from the providers, only available at the time of your booking.
3.2. You are responsible for ensuring that your details and trip information are accurate, including but not limited to choosing a vehicle that accommodates your luggage, a valid postcode that doesn’t involve traffic violations, the correct date and time for your travel, the right customer name, valid email address, and phone number. Providing accurate details or incorrect postcodes that lead to traffic violations may result in additional charges and potentially forfeit refunds. Your booking constitutes an offer that Taxipoint may choose to accept or not.
3.3. If you need to modify or correct a booking, you must contact Taxipoint directly. Should your requested changes lead to a price increase, you’ll be required to pay the difference between the cost of the initially booked services and the cost of the new services you requested.
3.7. Taxipoint reserves the right to correct any typographical errors, including pricing mistakes, in any information displayed on the website. If an error is found and you wish to withdraw your offer and not proceed with the purchase, you are free to do so, and any payment you’ve made will be fully refunded.
3.9. To ensure the successful completion of your booking, Taxipoint retains the right to alter the type of vehicle you initially booked. If the originally booked large vehicle is no longer available, Taxipoint will strive to provide similar alternatives.
3.10. Taxipoint may utilize third-party companies like Uber and Gett to fulfill your booking if the original provider cannot do so. To clarify, you agree and confirm that you will receive SMS messages from Uber and Gett about your trip and that you permit them to share information about your trip status with Taxipoint. 4. PAYMENTS
4.1. If you choose the ‘Pay by Card’ option while booking, you consent to pay the fare at the time of booking. Taxipoint has the right to collect all due payments for the scheduled trip from you and settle all card-related costs for the booked trip on behalf of the service provider in advance of making the necessary payment to the service provider for the booked trip as their agent.
4.2. If you choose to pay by card, you agree that Taxipoint can use an authorization token on your card, enabling us to charge your card for any amendments to your booking. Taxipoint will not retain any of your card details. If your card issuer declines your payment for any reason, Taxipoint will not be able to fulfill your booking.
4.3. If you select the ‘Pay by Cash’ option while booking, you agree to pay the fare directly to the provider.
4.4. In the event your card payment is denied by your card issuer for any reason, Taxipoint will not be able to carry out your booking.
4.5. Taxipoint will send a payment receipt to the email address you provided during the booking process.
4.6. The payment will not include any additional requirements you request unless you specify them during booking, such as child seats. If you fail to mention extra luggage that necessitates a larger vehicle, the provider may charge you an additional fee, which you will have to pay directly. If you decide to tip the provider, this is at your discretion and should be done directly.
4.7. If you deviate from the route that you provided on the website, you might be charged extra by the provider. You are required to pay these additional charges directly to the service provider.
5. Cancellation Policy
5.1. A reservation that has been confirmed by the provider may only be canceled by the passenger with the written agreement (via email, phone call, etc.) of the provider and under terms that align with the original booking purpose.
5.2. Passengers must notify of cancellations at least 5 hours before the scheduled booking time by telephone at +44208 087 0007 or by emailing info@thetaxipoint.co.uk.
5.3. All cancellations made at least 5 hours before the scheduled booking time will be eligible for a full refund.
5.4. Bookings made for vehicles that do not suit the passenger’s needs in terms of seating capacity or luggage space will attract cancellation charges of 50% of the total trip cost.
5.5. If a cancellation is made between 3 to 5 hours before the booking time, a cancellation fee of 50% of the service price will apply.
5.6. If a cancellation is not made at least 3 hours before the booking time, a cancellation fee of 100% of the service price will apply.
5.7. If the provider fails to arrive at the agreed pick-up point, the passenger is entitled to a full refund of the fare and any pre-paid card costs.
5.8. If the passenger is not at the agreed pick-up point within 15 minutes (for Airport 45 minutes) of the agreed time, the provider can choose to consider it a cancellation. The passenger will not be eligible for a refund of the fare or any pre-paid card costs. If the provider waits more than 15 minutes (Airport 45 minutes) past the agreed time, the passenger will be charged extra for the additional waiting time and parking charges, which must be paid directly to the provider.
5.9. In the event provider turns up and the passenger decides not to use the services for any reason and doesn’t cancel the booking via the website or by contacting the provider, no refunds will be provided.
5.10. For bookings paid in advance, any refunds due to cancellations or complaints will be returned to the card used for payment within 5 business days (Monday to Friday).
5.11. In case of booking cancellation or no-show by a provider, the passenger must contact TaxiPoint within 7 days to process their refund.
6. INSURANCE
6.1. Taxipoint holds no responsibility or insurance coverage for any damage or loss your belongings may incur during a trip. It is solely your responsibility to ensure that your goods are adequately insured against such damage or loss.
7. WARRANTY AND LIMITATION OF LIABILITY
7.1. The provider has assured Taxipoint of having appropriate licensing from the relevant licensing authorities, but Taxipoint is not responsible for verifying this assurance. If you have any doubts, you should reach out to the Private Hire Operator for confirmation and rely on your own verification.
7.2. In any event, Taxipoint will not be liable, under contract or otherwise, for any indirect or consequential loss or loss of revenue you might experience due to the provider’s failure or in connection with these Terms or any other matter. If you believe you have a claim due to a provider’s failure, you agree to address such claim directly to the service provider.
7.3. Unless specifically stated in these Terms, all warranties, conditions, or other terms implied by statute or common law are excluded to the maximum extent permitted by law.
7.4. Any estimated travel times or arrival times presented by Taxipoint on its public website or elsewhere are merely indicative and can be affected by traffic, weather conditions, or the provider’s chosen route. Hence, you accept that it is your responsibility to set a suitable agreed-upon time that allows you to reach your destination with enough time to check in for a flight, catch a train, or meet any other commitments you may have.
7.5. Taxipoint may keep you updated about your booking status via email and SMS text alerts. However, Taxipoint does not guarantee the delivery or timing of these alerts and will not be held liable, under contract or otherwise, for any indirect or consequential loss or loss of revenue arising from the omission or delay of such email and SMS text alerts.
7.6. Each of the preceding sub-clauses of this clause constitutes a separate and severable provision. The provisions of this clause will remain in effect regardless of the termination, completion, or any other matter that might otherwise render these Terms ineffective.
8. BEHAVIOUR
8.1. The provider has the right, within reason, to end the trip if your or your party’s conduct is disruptive or jeopardizes the safety of yourselves or the provider. Neither Taxipoint nor the provider assumes liability for any additional costs you or your party may incur as a result of the provider taking such action.
8.2. Passengers are not allowed to bring alcoholic beverages onto the vehicles with the intention of consuming them during the trip.
8.3. The provider also retains the right to deny transport to any individual suspected to be under the influence of alcohol or drugs.
9. LIMITATIONS AND EXCLUSIONS
9.1. The provider will not be responsible for the transport or delivery of:
Money, securities, antiques, precious metals, furs, or jewelry of any value, any goods or property (of any kind) that have an intrinsic value of more than £50. Any goods or property that is hazardous, dangerous, flammable, explosive, noxious, or illegal under current English Law and/or Any goods or property (of any kind) that may deteriorate during transit.
9.2. The provider will have no liability whatsoever for any loss or damage arising from the provisions of clause 10.1 of this agreement.
9.3. Without limiting the provisions of clause 10.1, under no circumstances will the provider be liable directly or indirectly for:
Consequential loss (whether for loss of profit or otherwise); and/or
Loss, damage, and/or breakage to any fragile items whatsoever, whether due to the actions, omissions, or negligence of the provider and/or its employees and/or agents or arising in any other way.
9.4. Without limiting the generality of clauses 10.1 and 10.2, the provider specifically will not be liable for any loss and/or damage arising directly or indirectly from:
Breakdowns, accidents, adverse weather conditions
Any action or omission on the part of the Customer.
Any clause, act, or circumstance beyond the provider’s control (including, but not limited to, any strike (official or unofficial), lockout, or another form of industrial action or labor dispute, government regulations, legal restrictions, embargoes, fire, flood, consequences of riot, war, invasion, the act of a foreign enemy, hostilities (whether war is declared or not), civil war, acts of terrorism, rebellion, military or usurped power, confiscation, requisition, destruction of or damage to property by or upon the order of or in the name of any Government or public local authority, or other conditions amounting to force majeure).
9.5. The provisions of clauses 10.1, 10.2, 10.3, 10.4, and 11.1 apply to liability for loss or damage to goods or property and do not apply to liability for death or personal injury.
9.6 – By utilizing the website, you acknowledge and agree that your use of the site is non-exclusive.
9.7 – Every time a booking is made, you acknowledge and agree, at the date and time of the booking, that these terms & conditions take precedence over any prior agreements or your terms and conditions.
10. DISPUTES
10.1. If you have any issues regarding the service provided by the provider, it is your responsibility to contact the provider directly, either via phone or email, within 24 hours of the agreed service time.
10.2. If you are still unable to resolve your issue with the provider, you must notify TaxiPoint through the Contact Us page form or by emailing info@thetaxipoint.co.uk within 72 hours of the agreed service time. Failure to do so will result in the invalidation of any potential claim you might have.
10.3. If TaxiPoint is unable to mediate a resolution to any claim you have regarding the service provided by the provider that satisfies both parties, TaxiPoint reserves the right to refer such claim to an independent third party of its choosing. You agree to abide by the decision of this third party.
